Terms of Service

These terms are the agreement between you and CubeBloom when you use the website or the app. They're written to be read, not skimmed past — the parts that cost you money are in Plans, prices and billing, and the parts that protect you are in Your rights under the Australian Consumer Law.

The checkout on the pricing page is currently a design mock — no payment is processed and no card details are transmitted. The billing clauses below describe how the live service is intended to work.

1. Who we are

2. Accepting these terms

By creating an account, subscribing, or otherwise using CubeBloom, you agree to these terms. If you don't agree, don't use the service.

If you're using CubeBloom on behalf of a school, club or organisation, you confirm you're authorised to accept these terms for them.

3. Age and eligibility

CubeBloom is available to people of any age, but if you're under 18 you need a parent or guardian's permission to create an account or buy a paid plan. Where a purchase is made by a minor, we may deal with the parent or guardian in relation to billing, cancellation and refunds.

4. Your account

  • Keep your login details to yourself — you're responsible for activity on your account.
  • Give us accurate details, and keep your email address current so we can reach you about billing and service changes.
  • Tell us promptly if you think someone else has accessed your account.

5. What CubeBloom does

CubeBloom records and imports your solves, splits them into phases, compares those phases against typical times for your speed and method, and builds drill plans from the result. Some features connect to a Bluetooth smart cube; others use your device's camera.

CubeBloom is a training tool. We don't promise a particular improvement, solve time, competition result or personal best. Analysis derived from video or camera capture is an estimate, and its accuracy depends on lighting, framing and how you turn.

6. Plans, prices and billing

Prices

All prices are in United States dollars (USD) and are exclusive of sales tax. Any sales, use or similar tax that applies where you live is calculated and added at checkout. The current plans are Free ($0), Beginner ($4.99 per month or $49.99 per year) and Intermediate & Advanced ($9.99 per month or $99.99 per year). The total you see at checkout, tax included, is the amount you pay.

Automatic renewal

Beginner and Intermediate & Advanced are subscriptions. They renew automatically at the end of each billing period — monthly or annual, whichever you chose — and we charge your saved payment method at the price shown when you subscribed. We will tell you before the first charge and before any price change takes effect, and you will always be able to see your renewal date and amount in your account.

Cancelling

You can cancel at any time from your account settings, in the same number of steps it took to subscribe. We will not ask you to phone us, email us or complete a retention flow to cancel. When you cancel, your plan stays active until the end of the period you have already paid for, and it does not renew after that.

Changing tier

You can move between the paid tiers at any time. Moving up takes effect immediately and we charge the difference for the rest of your current period; moving down takes effect at your next renewal, so you keep what you have already paid for. Your solve history is unaffected either way.

Failed payments

If a renewal payment fails we will try again and let you know. If it keeps failing, your plan drops back to Free. Your solve history is not deleted when that happens.

7. Your solves and your data

Your solve history belongs to you. By default it's stored in your own browser on your own device. You can export it at any time, on any plan, including after you cancel.

Because that data lives in your browser, clearing your browser storage or using a different device or browser will not show the same history. How we handle personal information is set out in our Privacy Policy.

8. AI coaching

CubeBloom's AI coach sends your question and a summary of your solve data to a third-party AI provider to generate a response. Those providers are outside Australia — see the Privacy Policy for where the data goes.

AI responses can be wrong. Treat coaching output as a suggestion to test, not instruction to follow. Don't put anything into the coach you wouldn't want processed by a third party.

9. Acceptable use

Don't:

  • share, resell or sublicense your account or a paid plan;
  • scrape, reverse-engineer, or try to extract our models, prompts or datasets;
  • upload video or images of other people without their permission;
  • interfere with the service, or attempt to get around usage limits or the paywall;
  • use CubeBloom to break the law, or to upload unlawful or infringing material.

We may suspend or close an account that breaches these rules. Where we do, we'll tell you why and — unless the breach is serious or unlawful — give you a chance to fix it.

10. Intellectual property

We own the CubeBloom name, software, course content, algorithm library and design. You get a personal, non-exclusive, non-transferable licence to use it for your own practice while your plan is active. You keep ownership of everything you upload or record.

11. Changes to the service and these terms

We may add, change or remove features. If a change materially reduces what a paid plan gives you, or if we change these terms in a way that disadvantages you, we'll give you at least 30 days' notice by email and you can cancel before it takes effect and receive a pro-rata refund of any unused prepaid period.

12. Your rights under the Australian Consumer Law

Nothing in these terms takes away your consumer guarantees.Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.

13. Our liability

Subject to section 12 — which always wins where the two conflict — and to the extent the law allows:

  • we're not liable for indirect or consequential loss, or for lost data where you had the ability to export it;
  • our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim arose.

We don't limit liability for fraud, or for anything the law says can't be limited.

14. Ending the agreement

You can stop using CubeBloom at any time. We can end this agreement by giving you 30 days' notice, or immediately if you seriously breach these terms. If we end it for convenience, we'll refund any unused prepaid period.

15. Governing law

These terms are governed by the laws of [your State or Territory], Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that place and of the Commonwealth of Australia.
